Car Accident Benefits
Car accidents occur frequently due to many factors such as distractions, fatigue, impaired driving, speeding and weather.
If you have been injured in a car accident in Ontario, regardless if you are at fault or not, you are entitled to claim benefits from your insurance company under the Ontario Statutory Accident Benefits Schedule (commonly known as “no-fault” insurance).
Additionally, if your car accident injuries are serious and permanent, you are also entitled to file a lawsuit against the at-fault party for damages arising from your injuries such as pain and suffering, loss of enjoyment of life, past and future income loss, and past and future medical and rehabilitation expenses.
There are important time limits related to both the Statutory Accident Benefits coverage and any potential lawsuit that may be filed on your behalf so it is very important that you contact your insurance company within 7 days of the accident, and also that you contact an experienced car accident lawyer as soon as possible since you must notify the other party of your intention to file a claim within 120 days of the accident.
