In September 2010 the benefits available to car accident victims changed.

Many benefits including income replacement, the definitions of minor and catostrophic injury, and the documentation and reporting requirements were clarifies and in some cases were narrowed and reduced.

What is a minor injury?
  A.   A minor injury is defined by the Statutory Accident Benefits as a sprain, strain, whiplash associated disorder, contusion, abrasion, laceration or subluxation and any clinically associated sequelae. If a car accident victim suffers from a minor injury then treatment is provided under the Minor Injury Guideline. The Guideline establishes a treatment framework in respect of one or more minor injuries.

 

Does the injured person have to be in a car to be eligible for accident benefits
  A.   Pedestrians and cyclists may also be entitled to accident benefits. Accident benefits are available to everyone who is injured directly as a result of a car accident. Accident benefits are also available to the driver of the car, regardless of who is at fault for the car accident.
